Proposed SEC Ban on Third Party Marketers
Several years ago, a group of unscrupulous marketers were involved in bribing public officials in exchange for pension business. These criminals were unfortunately called “placement agents,” sometimes also known as third party marketers, and thus tarnished the entire industry by their actions.
In an overreaction, the Securities and Exchange Commission proposed banning third party marketers from public pension work.
Both Steve and Ken wrote SEC Comment letters defending the industry (a PDF of Steve’s letter can be found here, Ken’s here).
Additionally, Steve wrote an Op-ed piece for FundFire in April, 2009, entitled “Ban on Agents is Insult to Institutional Salespeople” (PDF). Steve makes the point that in every industry there are unscrupulous actors, and that impugning an entire industry because of a few bad apples is shortsighted and completely unjust.
In May, 2009, the 3PM Association released a position paper on the proposed ban. The 3PM argues that thoughtful regulation and transparency is desirable, but that banning 3PMs from public pension work amounts to ‘throwing the baby out with the bathwater.” For the full paper, follow this link (PDF)
